MANUAL IN TERMS OF SECTION 51 OF THE PROMOTION OF ACCESS TO INFORMATION ACT NO 2 OF 2000 (“the Act”) IN RESPECT OF WARSHAY INVESTMENTS PROPRIETARY LIMITED TRADING AS KWV (“KWV”)

KWV is one of the leading wine and brandy producers in South Africa. Its head office is located in Paarl, in the Western Cape region – one of the country’s top wine producing regions.  The company sources wines and grapes from the best and most sought after viticultural regions in South Africa. KWV is known internationally for brands such as Roodeberg, The Mentors, KWV , Laborie, Golden Kaan, Cathedral Cellar, Café Culture, Pearly Bay and the KWV 3, 5, 10, 12, 15 and 20 Year Old brandies.

3. GUIDE IN TERMS OF SECTION 10 OF THE ACT [SECTION 51(1)(b)]

The Guide referred to in section 10 of the Act is a Guide compiled by the South African Human Rights Commission setting out in each official language, such information as may be reasonably required by a person who wishes to exercise any right contemplated in the Act. The Regulations promulgated in terms of the Act, published under Government Gazette No.23119 under Notice No. R187 of 15 February 2002 as amended from time to time, set forth how the South African Human Rights Commission should make the Guide available.

The Guide has been made available in each official language in the Government Gazette and is available for inspection by the public at the offices of the South African Human Rights Commission at the following addresses:

6. HOW TO REQUEST ACCESS TO A RECORD [SECTION 51(1)(e)]

Should you request information in terms of the Act, please complete the prescribed Form C of Annexure B, published in Government Gazette No. 23119 under Notice No. R187 of 15 February 2002, as amended from time to time (see copy attached).  The form is also available at our offices and at www.kwv.co.za.

Remember to:

• Indicate the form of access required.

• Provide sufficient particulars of the records required to enable the company to identify the record or records requested and the requestor

• Specify a postal address or a fax number in South Africa, or an e-mail address. 

• Identify the right you want to exercise or protect and give an explanation why the record is needed for this purpose.  

• Indicate the form of reply to your request, other than a written reply, which you prefer, with the relevant particulars. 

• Provide proof of the capacity in which you are acting, if requesting access on behalf of another.

The request for access to records will be deemed to have been made once the completed form has been received by our offices.

KWV’s Information Officer will gladly assist with the completion of the forms or any other queries relating to this manual or the Act.

Access to certain records may or must be denied under certain circumstances. Subject to certain exceptions and conditions in terms of the Act, such grounds include:

A requester who is dissatisfied with the Information Officer’s decision to not to grant a request for information, can in terms of the Act apply to a competent Court for relief.Requests for access to records must be submitted in accordance with the prescribed format and must be accompanied by the prescribed fee. A list of applicable fees is available in Annexure A to the regulations published in Government Gazette No. 23119 under Notice No.R187 OF 15 February 2002, as amended from time to time.Should you require further information on making requests for access to records, we refer you to the Guide, which has been published by the South African Human Rights Commission.
